{"id":4068,"date":"2024-02-07T10:50:58","date_gmt":"2024-02-07T09:50:58","guid":{"rendered":"https:\/\/sciberras.legal\/?p=4068"},"modified":"2024-02-07T10:50:59","modified_gmt":"2024-02-07T09:50:59","slug":"immigration-appeal-for-a-nepalese-client","status":"publish","type":"post","link":"https:\/\/sciberras.legal\/fr\/2024\/02\/07\/immigration-appeal-for-a-nepalese-client\/","title":{"rendered":"Immigration appeal for a Nepalese client"},"content":{"rendered":"<p class=\"wp-block-paragraph\"><strong>Pr\u00e9liminaire<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Un appel concernant une d\u00e9cision de rejet rendue par la Commission d'appel de l'immigration \u00e0 l'encontre de notre client, un ressortissant n\u00e9palais.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Faits<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Our client arrived in Malta in October 2022, and was then held at the Malta International Airport on the 7th of October 2022 as he was about to travel to Portugal. That same day the Principal Immigration Officer issued against him a decision for his return and for his removal from Malta.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Our client had stated to the Principal Immigration Officer that he was on his way to he attends the Dashain Festival which is celebrated by the people of Nepal, and he was going to return to Malta a few days later. It turned out that our client had a visa valid for the purpose of work from July 2022 to November 2022 and our client had already attended an interview but had not yet stated working.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>M\u00e9rite<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Sciberras Advocates appealed the decision before the Board in 2022 where we presented the submissions and also bail submission so that the appellant is to be released from detention.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>La d\u00e9cision dont appel<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">From evidence produced the Immigration Appeals Board decided that our client failed to convince this Board of his true intentions. Reasons given, that of travelling to Porto to participate in the Dashain festival does not tally and the single permit application had to be finalised first.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>L'Appel<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In April 2023, our firm presented an appeal on the decision to cancel the revoke the return decision and the entry ban issued by the Principal Immigration Officer in October. Our appeal consisted of various submissions, evidence produced and various legal considerations.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>D\u00e9cision de la cour d'appel<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">La Cour d'appel a accept\u00e9 l'appel de notre client et a r\u00e9voqu\u00e9 la d\u00e9cision initiale de la Commission concernant le retour et le renvoi de Malte, ainsi que l'interdiction d'entr\u00e9e \u00e9mise le m\u00eame jour, afin que notre client puisse pr\u00e9senter une nouvelle demande de permis de s\u00e9jour \u00e0 Malte.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Le jugement d\u00e9finitif peut \u00eatre t\u00e9l\u00e9charg\u00e9 ici : <a href=\"https:\/\/ecourts.gov.mt\/onlineservices\/Judgements\/Details?JudgementId=0&amp;CaseJudgementId=143669\" target=\"_blank\" rel=\"noreferrer noopener\">Malta Immigration Case 50 \/ 2023<\/a><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This was another success story for our firm, winning an appeal for a third country national who was ready to start his new job in Malta.
