{"id":5357,"date":"2026-03-11T13:54:04","date_gmt":"2026-03-11T12:54:04","guid":{"rendered":"https:\/\/sciberras.legal\/?p=5357"},"modified":"2026-03-11T13:54:09","modified_gmt":"2026-03-11T12:54:09","slug":"immigration-appeals-board-division-1-requests-authority-to-process-appellants-application","status":"publish","type":"post","link":"https:\/\/sciberras.legal\/fr\/2026\/03\/11\/immigration-appeals-board-division-1-requests-authority-to-process-appellants-application\/","title":{"rendered":"Immigration Appeals Board Division 1 Requests Authority to Process Appellant\u2019s Application"},"content":{"rendered":"<p class=\"wp-block-paragraph\"><em>Case Study: A win for Sciberras Advocates as the Immigration Appeals Board Division 1 decides in favour of our client<\/em>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Pr\u00e9liminaire<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Immigration Appeals Board, division 1, noted a refusal, issued by Identit\u00e0 in January 2025, where it was stated that the application, date October 2024, was refused as it transpired that the appellant\u2019s immigration position in Malta was irregular.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Facts of the Case<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Board notes a Decree that stated that the Board itself directed Identit\u00e0 to provide the same Board a timeline of events regarding the appellant within one week of the request, so that a decision could be taken by the same Board. Identit\u00e0 was notified, however no submissions and no timeline of events were filed. At this point, the Board could only reply on the submissions of the appellant, and it notes that the appellant has also found a new employer.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Board refers to the fact that this is not the fora of human rights. However, the Board has always seen the human dimension. From the facts stated by Sciberras Advocates, the appellant\u2019s lawyer, it seems that the appellant was caught in a bureaucratic procedure and that he never received a revocation letter of his residence card. As Identit\u00e0 did not file any submissions, it could not prove otherwise.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>The Decision<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Board accepts the appeals of our client and directs Identit\u00e0 to process the application. A notification of this decision was also sent to the Principal Immigration Officer.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This was another success story for our firm, and our client, a third country national caught in limbo in Malta.
