This involves establishing the preliminary conditions set when these tenements where initially sold. The responsibility for this task lies primarily with the notary public, who, after drafting a promise of sale agreement, must conduct thorough research to examine whether any servitudes are in place, and verify the validity of the legal title.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If the original contract of sale does not permit a particular servitude, the prospective seller cannot independently decide to include such. If this is the case, a correction to the contract of sale is necessary.
