Landmark Judgement: Malta Court Holds Bank Liable for Failing to Prevent Crypto Scam

In a recent landmark judgment, a Maltese court ordered a bank to pay €25,000 in damages after failing to intervene in a series of suspicious transactions linked to a crypto-investment scam. This ruling marks meaningful implications for both financial institutions and scam victims.

The Case: A Failure to Intervene

According to the court proceedings, the victim had been lured into a fraudulent online investment platform, a pattern increasingly seen in modern crypto-related scams. Despite clear red flags and transaction behaviour inconsistent with the customer’s typical financial activity, the bank processed each transfer without triggering internal safeguards or contacting the account holder. The court ultimately found the bank partially responsible, concluding that it should have acted proactively to halt or question the suspicious payments.

This is a critical development: for the first time, a Maltese court has formally recognised that financial institutions may bear liability when they fail to prevent fraudulent transfers involving crypto platforms.
