
Update on the Workforce Limitation Threshold set out in the new Malta Labour Migration Policy.
We would like to notify all local employers and Third Country Nationals (living in Malta or applying as ‘still abroad’) about the new Workforce Limitation Threshold set out in the Malta Labour Migration Policy.
Before submitting any new work single permit application, it’s important to be aware about this new rule. If the employer has already reached this limit, Jobsplus will not approve the application the work permit application for the Third Country National will be refused. This applies to new permit, change of employer and renewals.
Employers: What to do
Employers in Malta are encouraged to check about the Workforce Limitation Threshold on the Jobsplus portal. This can be checked by logging into the account. If the company has subsidiaries, then all of the employees will be counted together for the purpose of calculating the quota.
This threshold is aimed to control growth of a company in period of 1 year and calculations depend on the size of the company:
- Micro firms (1-9 employees): can grow yearly up to 200%
- Small firms (10-49 employees): can grow yearly up to 100%
- Medium firms (50-249 employees): can grow yearly up to 50%
- Large firms (250+ employees): can grow yearly up to 25%
Exemptions include:
- Occupations that fall under the health sector
- Occupations that fall under the care of persons with disability and the elderly
- Sportspersons
- KEI applicants
- TCN Students under LN (Level 5 or higher)

Third Country National Employees: What to do
To avoid possible refusals or falling into an irregular immigration situation if already in Malta, always ask your employer / prospective employer to confirm their status on the Jobsplus before submitting your application. In case of refusals, please feel free to reach out to regularise your immigration position or get assistance on how file an appeal.
