
Case Study: A win for Sciberras Advocates as the Immigration Appeals Board Division 1 decides in favour of our client.
Préliminaire
The Immigration Appeals Board, division 1, noted a refusal, issued by Identità in January 2025, where it was stated that the application, date October 2024, was refused as it transpired that the appellant’s immigration position in Malta was irregular.
Facts of the Case
The Board notes a Decree that stated that the Board itself directed Identità to provide the same Board a timeline of events regarding the appellant within one week of the request, so that a decision could be taken by the same Board. Identità was notified, however no submissions and no timeline of events were filed. At this point, the Board could only reply on the submissions of the appellant, and it notes that the appellant has also found a new employer.
The Board refers to the fact that this is not the fora of human rights. However, the Board has always seen the human dimension. From the facts stated by Sciberras Advocates, the appellant’s lawyer, it seems that the appellant was caught in a bureaucratic procedure and that he never received a revocation letter of his residence card. As Identità did not file any submissions, it could not prove otherwise.
The Decision
The Board accepts the appeals of our client and directs Identità to process the application. A notification of this decision was also sent to the Principal Immigration Officer.
